i got married in '69 and divorced a few years later. the worst event of my whole life. nothing else even comes close. lawyers seemed to push us into contesting each and every little detail of the divorce. a few years later i got married again and a few years after that i got divorced again only this time i bought a book with tear out pages and typed up everything myself. when we talked about the divorce i told her about my first divorce and the lawyers and how i did not even like my first wife anymore. she and i both wanted to avoid such an outcome, agreed on each aspect of the divorce in order to have a repeat of the first divorce. i know i agreed to a few things i might not have if not for the horrible first experience. and it worked out well if you can call a divorce a success.

My son will be 4 in Nov. 19, 2011.
I am completed focused on the best interest of our son and new court ruling has me devastated. I am single never married.
Dad gets 43% of custody time. I applied for Child support from Dad...now it's all turned around and I have to pay for everything. I have spent thousands on lawyer fees and the judge won't even look at new income and expenses motion.
I have never been in trouble with the law, don't smoke, drink....have always held a
steady job and have good references. I work especially hard with our son's special need to develop his language development.
Dad liquidated all his property and has Santa Barbara Charter and Yacht Sale business that has potential to earn millions and has in the past had very good earnings. I cannot afford more lawyers to fight this despicable man who twists every thing. Is this just a game for Dad? Dad is saying I make more money then he does...I am struggling to make ends meet financially. I need to appeal or something because the judge will not even look at at resubmitting my current Income and Earnings. In 2010 I was laid off my property management job due to economic reasons, but to on a new job for salary of $62,000 without changing custody commute time. I was previously unemployed approx. 6 months. I am a good mother and have paid for all child care & medical expenses etc during my pregnancy and since he was born.
Our son has special needs for speech therapy. At the advise of my pediatrician I have had our son tested and enrolled in language development. I communicated all reports to Dad and he did participate in language sessions. Now because I pick our son up court approved an earlier time, Dad is unhappy and is undermining my efforts to keep him enrolled in our local language development classes where I live and has him in a new enrollment in Santa Barbara this month. Dad says he is not a morning person and getting up early doesn't meet his life style. However our son is enrolled for the fall in Thousand Oaks where I live. I know Dad is trying to get him in school in Santa Barbara. I can no longer afford anything. I will loose my house if they garnish my wages. Dad was originally paying child support and then filed a motion to show cause of lower income from $25K / month to $1,387/ month. He is self-employed runs a tourist business and receives a lot in cash in his business. Runs his personal lifestyle expenses thru his business. At the time I had a lawyer and submitted all my pay stubs faithfully on my earnings and bonuses to him. My lawyer did not in a timely manner submit a 1419 form for Income and Expenses the courts asked. This why I retained a lawyer I thought. In the year 2009 to 2010 I earned approximately $88,000.00. My base salary was $50,000 and earned the rest in bonus for leasing property.
Dad now does not have to pay our son's expenses I endured of approximately $19,000 for 1/2 child care, health insurance and medical bills over the course of our son's life. Plus I am stuck paying back child support Dad over payed me, court costs for Dad's filing motion and child support of over $774 by the first of every month and $750 a month in arrears.

Dad deeded his house in Ventura, California back to his almost 90 year old parents. Dad recently purchased a Meridian Yacht and lives on board with our son on his custody days. Dad was originally court ordered to pay 1/2 of health insurance, 1/2 child care and 1/2 medical expenses... The reason he got so much custody time at our son's early months of life is that he claimed he did not want 3rd party childcare expenses and he would take care of the child on the days I worked..since he owns his own business..he told judge that's his busy time was on the weekend with boat charters, so I get him every weekends and Friday and Monday. Dad submitted to the court his own nanny expenses the days he has our son at his work. Also daycare expenses when he works out at the Santa Barbara Health club. Nanny is also an employee of his at his business on Santa Barbara water front. Also Dad has Santa Barbara health club dues each month.(tells the courts that he has to swim for heart condition had valve replacement several years ago.) What Dad claims he makes for personal income does not in anyway jive with what he has for personal expenses.
Dad shows on Income and Expense form that he makes less than only $1400 a month.
Dad's yacht is on expensive marina at Santa Barbara and another slip for a 40ft sailboat he does charters and is a yacht sales man as well. To live onboard one also has to have a permit, which he did not have until I asked the coast guard if he applied for permit. He has since applied for permit. I also know that if you live on board you must have insurance. I do not know if he carries this insurance. Dad's attorney is a litigation lawyer. In 2010 I was laid off due to economic times, but retained a job for $62,000. I feel that because he can deduct everything for his business, I get stuck paying child support. He also makes cash on charters he doesn't report to IRS. I can not afford forensic accountant to audit his business or how or when he pays himself his salary. I'm doing all the financial analysis / extractions of his many bank accounts.
He told me from the beginning when our son was born that he would get full custody and that I would pay. This so unbelievable and I do not know where to turn. I do not have any more money to spend on lawyers. I work very hard at my job as a Property manager in Thousand Oaks area. I bought a small 2 bedroom house built in the 1960's that was a fixer upper and have spent money and time fixing it to be habitable for my son and I. It's not much but it is home and has a backyard for our son. I still live with no counter top in my kitchen or bathroom.
The child support office will eventually have me selling my home for garnishing my wages to pay for child support I should not have to pay. I do not have the money to appeal..what can I do? I do not live the yacht life style his Dad lives and could never afford to.

I am 42 years of age and our son's father is 53 and his savings I believe over $200,000. I have no savings and owe a $300,000 mortgage and near $50,000 past attorney fees trying to defend myself for the best interest of my son.
The father is single never married bachelor and has different women on the boat overnight on occasions in our sons presence. He boosts about his yacht style of life while I am working my fingers to the bone to just to make my house payment and put food on the table.

I know this is difficult to digest and have tried to explain a little to you what I am going through. My family and friends have been very emotionally supportive to me, but do not have the financial means to help me.
I sincerely appreciate any advice or where to turn to in my desperate situation.
Are their any Attorney's that help out mother's that are strapped for the betterment of the community, pro bono, appellate intern attorney?

I need to address the order after hearing from May 23, 2011. All I want is to enjoy motherhood and I can't with this man that is an extreme narsictic person. I can't show this character to the courts in everything I read can turn against me. I need help from someone that knows how to deal with this extreme situation.

Sincerely,
Holly Winzenburg

Hmm it seems like your site ate my first comment (it was extremely long) so I guess I'll just sum it up what I had written and say, I'm thoroughly enjoying your blog. I as well am an aspiring blog writer but I'm still new to the whole thing. Do you have any tips and hints for newbie blog writers? I'd really appreciate it.

The boy's life has been turned upside down with the knowledge that Arnold Schwarzenegger is his father, but Arnold doesn't have to take responsibility and pay child support? Why am I not surpirsied that the law will not hold Arnold accountable for his actions? I'm pretty sure that what he did to the maid was also sexual harassment, as Baena could not refuse him without compromising her job security. When Maria Shriver leaked this to the LA Times did she care at all how it would affect the children? Mendacious woman downplayed allegations of groping, but now that SHE has been humiliated with a child born to the maid, she makes sure that everybody knows about it no matter what the consequences are for the children. The biggest victim is of course Baena's son.

Hollywood takes people from the gutter and makes idols (and Governors) out of them. It's pathetic.
